Maesycwmmer farm owner’s compensation claim upheld by High Court judge

A Maesycwmmer farm owner could receive extra compensation after being forced to sell land for the A469 relief road in 1991.

John Saunders of Tyn Y Coed farm has already received £280,000 in payment for a compulsory purchase order (CPO)  issued by Caerphilly County Borough Council.

But 25 years after the sale, a final settlement has not been made and High Court Judge today, June 12, declared his compensation claim should be considered by a tribunal.

Judge Milwyn Jarman QC said Mr Saunders was paid £190,000 plus interest in 1997, but upheld his application for compensation.

Judge Jarman ordered Caerphilly County Borough Council to refer his case to the Lands Chamber of the Upper Tribunal to work out how much Mr Saunders may be owed. 

Caerphilly County Borough Council has been contacted for comment.
